• Loss of data or corruption of data
• Loss of goodwill or reputation
• Business interruption
• Cost of procurement of substitute goods or services
• Any other intangible losses

This limitation applies regardless of the legal theory on which the claim is based (whether contract, tort, negligence, strict liability, or otherwise), even if we have been advised of the possibility of such damages.

Maximum Liability: In no event shall our total aggregate liability to you for all claims arising out of or relating to the Service exceed the amount you paid us to use the Service in the twelve (12) months preceding the claim, or one hundred euros (€100), whichever is greater. Since the Service is provided free of charge, this effectively limits our liability to €100.

13. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, the provision shall be severed from these Terms.

The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision of these Terms, and the remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy and any other legal notices or policies published by us on the Service, constitute the entire agreement between you and Utilitiz regarding the Service and supersede all prior or contemporaneous understandings and agreements, whether written or oral, regarding the Service.
